Florida Court: India Permits International Child Abduction

We have just obtained the text of a final judgment from a Florida court that expressly endorsed and adopted the expert testimony of Jeremy Morley concerning the substantial risk of international child abduction to India.

The Court stated as follows:

“The Court heard testimony of Jacob [Jeremy] Morley, Esq., an expert in the area of international child abduction in general and specifically regarding the issue of child abduction in India and Indian laws and procedures regarding foreign judgments.

The reputation of India is nefarious for refusing to enforce child custody orders of foreign nations. Evidence was received that India has refused to adopt international treaties regarding foreign custody orders and is a haven for international child abduction.

India is not a party to the Hague Convention and has further enacted laws that discourage extradition of violators of United States laws.

It is the opinion of the Court the Court that if a child were abducted to India there is no way a parent could get that child back.”
